These Terms and Conditions are between you and Consumer Services, Inc. ("Consumer Services" or "we" or "us") concerning your use of the site located at www.creditscorequick.com (together with any successor site and all Services (as defined below), referred to in these Terms and Conditions as the "Site").

ACCEPTANCE OF TERMS

The Site is made available by Consumer Services subject to these Terms and Conditions. We reserve the right to update or make changes to them from time to time in our sole discretion, and we may provide such changes to you by any reasonable means, including, without limitation, by posting the revised version of these Terms and Conditions on the Site. You can determine when these Terms and Conditions were last revised by referring to the "LAST UPDATED" legend at the top. When using any Services (as defined below), you are subject to any additional guidelines, rules, terms, and conditions provided with them, which are incorporated by reference into these Terms and Conditions.

We reserve the right, at any time, temporarily or permanently, to: modify or discontinue the Site or any part of it, with or without notice; change any fees charged in connection with the Site; and/or offer opportunities to some or all users. We shall not be liable to you or to any other person for any modification, suspension, or discontinuance of the Site (or any part of it), or of any product or service offered through it. Your continued use of the Site after such changes will indicate your acceptance of them.

The Site is not directed to individuals under the age of eighteen (18). If you are under 18 years of age, you may not register for, enroll in, and/or make product or service purchases.

INFORMATION SUBMITTED THROUGH THE SITE; YOUR ACCOUNT

Your submission of information through the Site is governed by our Privacy Policy, which is located at www.creditscorequick.com/freescore (the "Privacy Policy") and incorporated into these Terms and Conditions by reference. The Services provided under these Terms and Conditions are web-based, and you agree to accept our Privacy Policy, revisions to our Privacy Policy, and the provision of an annual Privacy Notice electronically.

Any information you provide is and shall remain true, accurate, and complete, and you will maintain and update it as necessary. If any information you provide is false, inaccurate, obsolete, or incomplete (or if we have reasonable grounds to believe that it is), we may suspend, terminate, or restrict your use of the Site and/or any of the Services without liability to you or any other person. You will use the Services only for your own personal non-commercial purposes and not on behalf of any other person.

Your user name and password are for your personal use only. You are responsible for maintaining the confidentiality and security of your password and agree not to transfer it, or otherwise transfer your use of or access to the Site, to any other person. You are fully responsible for all interaction with the Site that occurs in connection with your password or user name (including all purchases). You will immediately notify Consumer Services of any unauthorized use of your password or user name or any other breach of security related to your account or the Site. You also agree to “log off”/exit from your account at the end of each session.

DISCLOSURE OF USER INFORMATION

You acknowledge and agree that we may access, preserve, and disclose your user information and any other information you provide if required to do so by law or in good faith belief that such access, preservation, or disclosure is reasonably necessary in our opinion to: (1) comply with legal process, including but not limited to civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce these Terms and Conditions; (3) respond to claims of a violation of the rights of third parties; or (4) protect our rights and property.

DESCRIPTION OF THE IDENTITYLOGIC SERVICES

We provide Site users with access to certain content and the opportunity to purchase services related to identity monitoring. Such content and services are known as the IdentityLogic service and, together, are referred to in these Terms and Conditions as the "Services." The Services are not credit counseling services or credit repair services. The actual products and services provided within any particular IdentityLogic service plan may vary depending on the plan that you select and may change from time to time.

Important Disclosures About Information Received from Credit Reporting Agencies

All components of the Services that contain or involve information from your file at one or more of the three national credit reporting agencies (Equifax, Experian, TransUnion, together referred to as the "CRA Repositories") are provided by CoreLogic Credco, LLC ("Credco"). These components, including credit reports, are intended to furnish you with information that you may not otherwise have readily available to you, but should not be relied upon for important personal and financial decisions. You should consult your own professional adviser for specific advice tailored to your personal situation. Any credit scores provided are for educational purposes only and are not an endorsement or guarantee of your credit worthiness as seen by lenders. There are many scoring models used in the marketplace, and each may have its own set of factors and scale. The information and credit scoring model provided here may be different than that used by a lender. Specifically, any credit scores provided here (a) may not be identical in every respect to any credit score used by your lender, (b) are not so-called FICO scores, and (c) may differ for a variety of reasons. Credit files are updated constantly, and neither we, our affiliates, nor the CRA Repositories can guarantee the accuracy of your file or score.

You are not required to pay a fee to see a copy of your credit report under certain circumstances, and you may obtain a copy of your report from each CRA Repository once per year for free by visiting www.annualcreditreport.com, by calling (877) 322-8228, or by writing to Annual Credit Report Request Service, P.O. BOX 105281, Atlanta, GA, 30348-5281 (Please use the form found on www.annualcreditreport.com). The Services provided by us are not affiliated with the free annual credit report site or program, which is explained more fully below. You may also contact each of the CRA Repositories to obtain a copy of your file. Please review the information below related to your rights under the Fair Credit Reporting Act ("FCRA"), including information on contacting the CRA Repositories.

FCRA Disclosures

The FCRA allows you to obtain a copy of all of the information in your consumer credit file from consumer reporting agencies for a reasonable charge. This information must be obtained directly from the CRA Repositories:

The FCRA also states that you are entitled to receive a disclosure directly from the consumer reporting agency free of charge under the following circumstances:

  • You certify in writing that you are unemployed and intend to apply for employment in the 60 day period beginning on the day you make the certification;
  • You are on public welfare assistance;
  • You have reason to believe that your file at the consumer reporting agency contains inaccurate information due to fraud; or
  • You have been denied credit, insurance, or employment in the past 60 days as a result of your credit report.

The FCRA also permits you to dispute inaccurate information in your credit report without charge. Accurate information cannot be changed. You do not have to purchase your credit report or other information from Consumer Services to dispute inaccurate or incomplete information.

The credit reports you request through the Services are not intended to constitute the disclosure of Experian, Equifax or TransUnion information required by the FCRA or similar state laws.

The FCRA allows you to get one free comprehensive disclosure of all the information in your credit file from each of the CRA Repositories once every 12 months through a central source. Although comprehensive, the credit reports that are available from us may not have the same information as a credit report obtained directly from the three CRA Repositories or through the central source. To request your free annual report under the FCRA, go to www.annualcreditreport.com, call toll free (877) 322-8228, or use the mail request form available at the central source website and mail to Annual Credit Report Request Service, P.O. BOX 105281, Atlanta, GA, 30348-5281. The Services are not related to the free FCRA disclosure.

Consumers residing in Colorado, Maine, Maryland, Massachusetts, New Jersey, and Vermont may receive an additional free copy of their credit report once per year, and residents of the state of Georgia may receive two (2) additional copies per year. For Illinois residents, credit reporting agencies are required by law to give you a copy of your credit record upon request at no charge or for a nominal fee.

YOU UNDERSTAND THAT BY CLICKING THE "COMPLETE ENROLLMENT" OR "CONFIRM ACCOUNT" BUTTON ON THE SERVICE ENROLLMENT PAGE, YOU ARE PROVIDING "WRITTEN INSTRUCTIONS" IN ACCORDANCE WITH THE FCRA (AS DEFINED ABOVE) FOR CONSUMER SERVICES AND ITS AFFILIATE CORELOGIC CREDCO, LLC ("CREDCO") TO OBTAIN INFORMATION FROM YOUR PERSONAL CREDIT PROFILE FROM ANY CONSUMER REPORTING AGENCY. YOU ALSO AUTHORIZE CREDCO AND CONSUMER SERVICES TO OBTAIN SUCH INFORMATION TO VERIFY YOUR IDENTITY OR DETECT POTENTIAL IDENTITY THEFT OR FRAUD, AND TO PROVIDE YOU WITH CREDIT MONITORING, CREDIT REPORTING, AND SCORING PRODUCTS FOR PURPOSES OF MONITORING YOUR IDENTITY.

YOU UNDERSTAND THAT IT MAY BE A VIOLATION OF FEDERAL AND/OR STATE LAW FOR YOU TO OBTAIN A CREDIT REPORT ON ANY PERSON OTHER THAN YOURSELF, AND THAT UNDER THE FCRA, ANY PERSON WHO KNOWINGLY AND WILLFULLY OBTAINS INFORMATION ON A CONSUMER FROM A CONSUMER REPORTING AGENCY UNDER FALSE PRETENSES SHALL BE FINED UNDER TITLE 18, UNITED STATES CODE, IMPRISONED FOR NOT MORE THAN 2 YEARS, OR BOTH.

NOT A CREDIT REPAIR ORGANIZATION

We and our affiliates are not credit repair organizations, and are not offering to sell, provide or perform any service to you for the express or implied purpose of improving your credit record, credit history or credit rating or providing advice or assistance to you with regard to improving your credit record, credit history or credit rating. You acknowledge and agree that you are not seeking to purchase, use or access any of the products or services or the Site in order to do so.

Services Plan Components

The services provided within any particular IdentityLogic service plan vary depending on the plan that you select, and they may change from time to time. They may be subject to additional conditions, limitations, and restrictions. In addition, to the extent that they contain or are derived from information received from credit reporting agencies, they are subject to the important disclosures above. The services may include:

One Bureau Credit Observer:This service monitors your Experian credit file on a daily basis and alerts you when there are changes to it. In order for you to receive this service, Experian must maintain a file on you.

Experian provides alerts for the following changes to your Experian report:

  • New address: This alert generates when a new address is being reported as your current mailing address on file with the bureau.
  • Bank / Credit Card Over Credit Limit: this alert generates when your bank or credit card company has reported that your use of your credit card has exceeded the amount of credit extended to you.
  • Public record bankruptcy: This alert generates when a court record is received indicating you have filed for bankruptcy.
  • Tradeline bankruptcy: This alert generates when one of your creditors has indicated that you have filed for bankruptcy.
  • New Lien / Judgment: This alert generates when a lien has been filed against your interest with a public records source like a county clerk or tax assessor or a judgment has been entered against you in a court.
  • New inquiry: This alert generates when a request for your credit report is made to open an account. These inquiries should reflect only when you have granted permission for your credit report to be reviewed.
  • Major Derogatory: This alert generates when an account is being reported as more than 90 days past due.
  • Account Past Due: This alert generates when an account is reported 30 to 60 days past due.
  • New trade: This alert generates when a new account is being reported on your credit report.

In the future, we may offer the opportunity to choose which bureau report is monitored for purposes of receiving the One Bureau Credit Observer service. Below is a listing of the changes currently monitored by Equifax and Trans Union (they are subject to change):

Equifax Alerts
  • Name (Change): This alert generates when the bureau has received notice that you have changed your name, such as when you get married.
  • Address (New): This alert generates when a new address is being reported as your current mailing address on file with the bureau.
  • Address (Change): This alert generates when a new address is being reported as your current mailing address on file with the bureau.
  • Suit or Judgment/ Tax Lien (New): This alert generates when a lien has been filed against your interest with a public records source like a county clerk or tax assessor or a judgment has been entered against you in a court.
  • Bankruptcy (New): This alert generates when the bureau has received information indicating that you have filed for bankruptcy, such as a filing from court records.
  • Collections (New): This alert generates when one of your creditors reports that they have placed your account with a collection agency.
  • Account / Trades (New): This alert generates when a new account is being reported on your credit report.
  • Inquiry (New): This alert generates when a request for your credit report is made to open an account. These inquiries should reflect only when you have granted permission for your credit report to be reviewed.
Trans Union Alerts
  • New address: This alert generates when a new address is being reported as your current mailing address on file with the bureau.
  • New employment: This alert generates when the bureau receives information that you have a new employer.
  • New inquiry: This alert generates when a request for your credit report is made to open an account. These inquiries should reflect only when you have granted permission for your credit report to be reviewed.
  • Derogatory trade: This alert generates when an account is reported 30 or more days past due.
  • New trade: This alert generates when a new account is being reported on your credit report.
  • Improved trade: This alert generates when an account previously reported as derogatory shows an improvement.
  • Tradeline bankruptcy: This alert generates when one of your creditors has indicated that you have filed for bankruptcy.
  • New public record: This alert generates when a new public record is being reported on your credit report, such as a judgment entered against you by a court.
  • Public record bankruptcy: This alert generates when a court record is received indicating you have filed for bankruptcy.
  • True name fraud consumer statement: This alert is generated when you have filed a consumer statement with Trans Union indicating that you have been a victim of identity theft.

Three Bureau Credit Observer: This service monitors your credit files at each of the three major credit bureaus (Experian, Equifax, TransUnion) on a daily basis and alerts you when there are changes to them. In order for you to take full advantage of this service, each of the bureaus must maintain a file on you. Please see the descriptions above of the types of changes that each bureau will report.

One Bureau Credit Reports: This service provides you with your Experian credit report and credit score every thirty (30) days. In order for you to take advantage of this service, Experian must maintain a file on you.

Credit Score Trend: This service provides you with your Experian credit score monthly (without the need to obtain a credit report). Your score is plotted on a graph so that you can track changes to it over time. In order for you to take advantage of this service, Experian must maintain a file on you.

ScoreLogic Simulator: The purpose of the simulator is to provide you with an interactive tool to aid your general understanding of how credit scoring systems work. By using the interactive tools (such as the CreditXpert Score and Analysis and the CreditXpert What-If Simulator), you agree that they are made available to you as educational tools for your independent, personal use. Consumer Services does not represent or guarantee their accuracy or their applicability to your circumstances, or that they will help you raise your credit score, or establish or re-build good credit, or improve your credit record, credit history or credit rating. Consumer Services does not represent that the tools are identical to any scoring model used by a lender to which you may apply for credit. As such, the tools cannot be used to predict your likelihood of obtaining credit or the terms of any credit that may be extended to you, including interest rate.

You also understand that the results of these tools are not intended to suggest or recommend that you take any particular action in order to improve your credit rating or standing. If you require recommendations or suggestions, you should consult your own professional adviser for information tailored to your personal circumstances. In order for you to take advantage of this service, one of the three major credit bureaus must maintain a file on you.

Identity Updater: This service permits you to dispute inaccuracies within your credit file at each of the three major credit bureaus with just one phone call. Please note that the FCRA (as defined above) permits consumers to dispute inaccurate information without charge. Accurate information cannot be changed. You do not have to purchase your credit report or other information from Consumer Services to dispute inaccurate or incomplete information in your credit file maintained by the CRA Repositories.

Identity Fraud Alert Assistance: In the event that you become a victim of identity fraud, our fraud case managers will assist you in placing fraud alerts with each of the three major credit bureaus. Please note that you must place the alert yourself. We assist with that process.

Identity Fraud Restoration Consultant: In the event that you become a victim of identity fraud, we will assign a case manager who will assist you in the process of restoring your identity. We do not guarantee that we can restore your identity and do not provide incident based services. Rather, our services are available to you for as long as you are a member of our service. We will make reasonable efforts to assist you with restoring your identity; however, due to the nature of identity crimes, we cannot guarantee that you will not continue to experience difficulties, which may include and are not limited to new account fraud, increased scrutiny when opening new accounts, and existing account fraud.

Checking Account Reports: This service assists you with requesting your checking account report annually. In order to take advantage of this service, ChexSystems must maintain a file on you.

Identity Warranty: The AIG Personal Internet and Identity CoverageSM service is underwritten by American International Specialty Lines Insurance Company. For loss resulting from stolen identity events first occurring during your period of coverage, you will receive coverage for certain expenses up to $1,000,000 during the coverage period. The coverage does not apply to: (1) loss due to any dishonest acts by you or with your participation or knowledge or by a member of your family; (2) bodily injury; or (3) loss due to acts of war or terrorism or to pollution. To be eligible for coverage, a loss must be reported to AIG within six months of a stolen identity event. Please note: coverage is subject to additional conditions, limitations, and exclusions. COVERAGE IS NOT AVAILABLE TO RESIDENTS OF NEW YORK FOR COVERAGE OF $1,000,000; HOWEVER, NEW YORK RESIDENTS MAY BE ELIGIBLE FOR COVERAGE UP TO $25,000.

BILLING AND CANCELLATION POLICIES

By placing an order, you authorize Consumer Services to bill the membership fee plus applicable taxes for the Services on a recurring basis (monthly or annually) to your credit card account at the rate then in effect until you cancel your membership by calling us at (855) 435-6442. If you make additional purchases during your membership (including during any free trial period), they will be charged to the credit card you provided at enrollment. If you use a different card, or if you update your payment information, Consumer Services will charge the latest card provided by you. You represent that you have the legal right to use any credit card(s) that you use for any Site purchase.

You may cancel your membership at any time by calling us at (855) 435-6442. If you cancel, your membership will continue until the end of your current paid period. There are no refunds, other than described below in connection with "money back guarantee" offers.

If your order is subject to a free trial period, you will submit your credit card information when you sign up. Consumer Services will verify that information before processing your order. An authorization will be performed on your credit card to ensure that it is valid and in good standing. The authorization amount may count against your credit limit; however, Consumer Services will not bill you the monthly membership fee until the free trial period has ended. To avoid being charged, you must cancel before the end of the free trial period. Please allow up to one (1) month for reversal of the authorization fee. To cancel, call us at (855) 435-6442. Limit: one (1) free trial offer per person.

If your order is subject to a money back guarantee offer, you must pay upon enrollment. If you are not satisfied with the Services, you will receive a full refund if you call us at (855) 435-6442 within the time period specified in the offer and request a refund.

SALES POLICIES

All product and service features are subject to change at any time without notice. By placing an order, you represent that you will use the ordered products or services in a lawful manner. We reserve the right, with or without prior notice, to limit the availability of or discontinue any product or service; to impose conditions on the use of any coupon or other promotion; to bar any user from making a purchase(s); and/or to refuse to provide any user with any product or service.

All orders placed through the Site are subject to our acceptance. Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline it for any or no reason and without liability to you or anyone else. Prices are in U.S. dollars, are subject to change, and do not reflect any applicable taxes. You agree to pay all charges incurred by you or on your behalf at the price(s) in effect when such charges are incurred, plus any applicable taxes. In the event a product or service is listed at an incorrect price due to a typographical error, error in pricing information received from our suppliers, or other error, we shall have the right to refuse or cancel any orders for products or services listed at the incorrect price, whether or not the order has been confirmed.

  • Any unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," "chain letter," "pyramid scheme" or investment opportunity, or any other form of solicitation.
  • Any material, non-public information about a company without the proper authorization to do so.
  • Use the Site for any fraudulent or unlawful purpose.
  • Use the Site to defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Site.
  • Impersonate any person or entity, including without limitation any representative of Consumer Services; falsely state or otherwise misrepresent your affiliation with any person or entity; or express or imply that we endorse any statement you make.
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available, or violate any requirements, procedures, policies or regulations of such networks.
  • Restrict or inhibit any other person from using the Site (including without limitation by hacking or defacing any portion of the Site).
  • Use the Site to advertise or offer to sell or buy any goods or services without our express prior written consent.
  • Reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Site.
  • Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Site.
  • Remove any copyright, trademark, or other proprietary rights notice from the Site or materials originating from the Site.
  • Frame or mirror any part of the Site without our express prior written consent.
  • Create a database by systematically downloading and storing Site content.
  • Use any robot, spider, site search/retrieval application, or other manual or automatic device to retrieve, index, "scrape," "data mine," or in any way gather Site content or reproduce or circumvent the navigational structure or presentation of the Site without our express prior written consent. Notwithstanding the foregoing, Consumer Services grants the operators of public search engines permission to use spiders to copy materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Consumer Services reserves the right to revoke these exceptions either generally or in specific cases.

Additionally, you acknowledge and agree that you (and not Consumer Services) are responsible for obtaining and maintaining all telecommunications, broadband, and computer hardware, equipment, and services needed to access and use the Site, and paying all charges related thereto.

Because we use security measures designed to protect your privacy and to safeguard your information, we may not always be able to successfully provide the Services to you, including instant online delivery of your credit report. For certain Services, when the system is unable to verify your identity, you may be routed through a manual authentication process.

You must have an email address and a Java-compatible browser such as Internet Explorer 7 or 8, or Firefox 3.6 or 4.0 to receive the Services.

The absence of other CoreLogic marks does not constitute waiver of any intellectual property rights in connection with those marks. All other marks and logos not owned by CoreLogic belong to their respective owners. You agree not to use any of the CoreLogic marks for any purpose without prior written consent from CoreLogic. You also agree not to use those marks and logos owned by others, such as the CRA Repositories without receiving written permission from them.

Because we have no control over such sites and resources, we are not responsible for their availability do not endorse them, and are not responsible or liable for any content, advertising, products, or other materials on or available through them. Other web sites may provide links to the Site with or without our authorization, and we do not endorse them and are not responsible or liable for any content, advertising, products, or other materials available on or through them. YOU AGREE THAT YOUR USE OF THIRD PARTY WEB SITES AND RESOURCES IS AT YOUR OWN RISK. Consumer Services shall have the right, at any time and in its sole discretion, to block links to the Site through technological or other means without prior notice.
